Patient sues for failure to diagnose a spinal tumor

April 13th, 2017
On behalf of David Bowling of The Bowling Law Firm, A Professional Law Corporation posted in Medical Malpractice on Thursday, April 13, 2017.

A patient in a midwestern state has filed a lawsuit against a physician and the medical group that he works with, claiming that they failed to diagnose the woman with a spinal tumor. The complaint was filed on March 20 against the doctor and his group and alleges that the defendants did not provide a standard of care that would be accepted in the chiropractic or medical community. Medical malpractice lawsuits are common in Louisiana, and other states, where failure to diagnose is an issue.

The woman asserts that in Sept. 2006 she began to complain of pain in her neck and discomfort, mostly in the area of the cervical spine. It took until April 22, 2015, for her to finally be diagnosed with a tumor in her spine, known as a tenosynovial giant cell tumor. According to her claim, she is still in a great deal of pain and anguish because the doctor did not correctly diagnose her problem.

The woman adds that the doctor and his medical group did not regularly monitor her progress and condition. She also alleges that they didn’t take the needed X-rays on a regular basis in order to properly tend to her care. The group is also said to have failed to give her a referral to a specialist when they could no longer treat her condition.

This woman is seeking in excess of $50,000, along with the costs of her lawsuit and any other monetary award that the court deems proper. In Louisiana, if a person has suffered because of a doctor’s failure to diagnose an illness or injury, a medical malpractice lawyer can help assess the circumstances and determine if grounds exist for filing a claim in civil court. Any compensation awarded from a successfully presented claim can help cover medical bills, lost income and other documented damages recognized by applicable laws.
