Joan Rivers’ Daughter Files Medical Malpractice Claim

The New Orleans Advocate reports that the daughter of comedian Joan Rivers is filing a medical malpractice claim against the clinic where her mother died. According to Melissa Rivers, doctors performed a number of unauthorized procedures on her mother and even took photographs of her during while she was unconscious. She believes their recklessness resulted in the doctors failing to notice Rivers’ vital signs deteriorating until it was too late to save her.

The 81-year-old comedian had gone in for a routine procedure in September of last year. She was having an endoscopy at a prominent clinic when she stopped breathing and died. Court documents indicate the doctors were allegedly arrogant and careless, and suggest Rivers died purely due to their incompetence.

The documents do not include the amount in damages that Melissa is seeking. A medical examiner from the state found Rivers died of brain damage due to a lack of oxygen.

Officials classified her death as a therapeutic complication. At the time, they did not claim they suspected negligence, but the lawsuit now indicates otherwise.

Patient Sues Doctor and Hospital for Leaving Implement inside Her

The Louisiana Record reports that a woman who claims doctors left a surgical instrument in her following surgery is suing the doctor and hospital for medical malpractice. Doctors had to remove the implement in a subsequent emergency procedure. The woman says she had surgery to remove a gastric band that doctors had implanted, but 2 days later, she returned to the hospital with severe pain and vomiting.

Doctors performed a scan, which revealed there was a foreign object still inside her body. The woman had emergency surgery to remove the object, which doctors identified as a surgical implement. Doctors have not yet given an explanation as to what the instrument was or how it might have stayed in her body following the procedure.

The woman is seeking an unspecified amount in damages for medical expenses, pain and permanent disfigurement. She also claims she suffered mental anguish and emotional stress due to the doctor’s negligence. She has factored all of this into her claim.
