Mother Sues Doctor After Alleged Misdiagnosis of Her Son

Louisiana Record reports on a tragic case involving a man who died after a doctor allegedly misdiagnosed him in the emergency room. According to the report, the victim’s mother filed suit against the doctor who sent him home from the hospital without properly treating him. The patient later died from fluid accumulating in his brain.

The plaintiff claims the doctor failed to diagnose the fluid buildup before sending her son home with a simple diagnosis of vertigo. She contends he later died due to a lack of treatment for the actual problem at hand, and she is suing the defendant for medical malpractice. The victim’s mother is seeking an unspecified amount in damages for suffering mental anguish.

Doctor Allegedly Leaves Sponge in Patient After Surgery

Louisiana’s Legal Journal reports on a case involving a doctor who allegedly left a sponge in one of his patients after a surgical procedure. The plaintiff is suing both his physician and the surgery center for purportedly breaching standards of care. He claims he was suffering from back pain when he made an appointment with the defendant in 2011.

His petition states the doctor acted conservatively in regard to care but finally recommended and performed a procedure on his spine. The surgery occurred on Nov. 18, 2011. The plaintiff claims the medical staff did not wait a long enough time between when he received antibiotics and when they began operating.

He purports that following the surgery, he developed oozing and persistent pain originating from the surgical site. He claims he returned to his physician for multiple follow-up appointments and finally underwent a second surgery on Mar. 9, 2012 to remove a sponge that was still in his body from the original surgery. He is accusing the defendants of negligence, as well as failure to conduct an accurate sponge count and failure to provide appropriate follow-up treatment.
