Home day care provider guilty of causing brain injuries on infant

Perhaps one of the hardest cases of personal injury to process is one that involves a child. When a person entrusts the care of their child to a professional, they do so with full trust that the child will be safely cared for. For one parent in another state, fears became reality when it was discovered that the person who was trusted to care for a baby ended up causing serious brain injuries. Although this particular case did not happen in Louisiana, it is the kind of nightmare that could take place anywhere.

A 33-year-old home day care provider was found guilty of assault in the first degree after a court proved that she had caused the significant injury to a 13-month-old boy that she had been caring for. According to the report, the woman called emergency services on September 22, 2016, in the early afternoon hours. She stated to the 911 operator that the baby was non-responsive and stiff. At that time, the woman claimed that she had simply woke him up from a nap and found him that way.

She had been keeping the boy since he was 9 months old. On that particular morning, she claimed that he woke up earlier in the morning, crying, and she changed his diaper. She then fed him and placed the boy in his playpen. She then began to home-school her own four kids. The next time he woke up, she was calling 911.

Doctor’s give a different image of what happened to the boy, however. The medical report shows that the baby was most likely shaken or thrown down in order to suffer the injuries that he had. The baby now has permanent brain damage from the incident.
