$23.1M verdict in birth brain injuries case

One family has been awarded over $23.1 million in a medical malpractice suit for a baby who has ongoing health issues due to birthing complications. The child reportedly suffered brain injuries due to the negligence of a neonatologist. Although this case was not in Louisiana, similar medical malpractice suits are filed in the state every year.

According to the ruling, the judge found that the doctor was negligent and the hospital was not. The doctor did not work directly for the hospital but for another Firm that provided services for the facility. The hospital is, however, liable for at least half of the damages that were awarded to the family. Prior to the decision, both the hospital and the doctor had filed stipulations which showed an agreement not to appeal the judge’s ruling.

During the birth, the baby suffered massive blood loss but waited three hours for a transfusion. She suffered brain damage from the mistake and has numerous ongoing health problems, including epilepsy and cerebral palsy. She completely relies on someone else to take care of all of her bodily functions, so her mother had to quit work to care for her. The child is now in physical, occupational and speech therapy.
